Britain’s Employment Tribunals receive nearly 100,000 applications every year. Every single one cost an employer time and money, which they can never recover. The DTI’s own figures show that the average cost is £2,000 per claim. It is almost certainly an underestimate.
Tribunals can – and do – order a business to pay an employee up to £50,000. Usually, the employer has simply not followed the correct procedures.
For claims involving sex, race or disability discrimination, there is no limit. Very often, the discrimination is completely accidental. Advertising for jobs is a particular minefield.
At the same time, there are many cases of employees misbehaving, misusing the internet, or even stealing the company’s business secrets. Without written contracts and policies, it is very difficult to stop. And few businesses realise that even internal, personal e-mails can land an employer in big trouble – over £400,000 of trouble in one case
